1) Welcome & Acceptance of Terms
Welcome to Fabulous Ceremonies Aruba (“Company,” “we,” “us,” “our”). These Terms of Service (“Terms”) govern your use of ArubaCeremonies.com (the “Site”). By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please discontinue use of the Site.

2) Who We Are & What This Covers
We are a non-denominational and interfaith ministry based in Aruba, specializing in destination wedding, elopement, intimate wedding, and vow-renewal officiant services. The Site provides general information, inspiration, and the ability to contact us. Use of the Site does not create a client relationship. Any ceremony or add-on services you purchase are governed by a separate, written Service Agreement signed at booking.

3) Privacy & Electronic Communications
Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and safeguard your data. When you visit the Site or email us, you are communicating electronically and consent to receive electronic communications from us. Notices, disclosures, and other communications we provide electronically satisfy any legal requirement that they be in writing.

4) Use of the Site
You agree to use the Site in a lawful, respectful manner. You will not:
  • Attempt unauthorized access, test vulnerabilities, or interfere with Site operation;
  • Use automated scraping, spidering, or harvesting tools without written permission;
  • Impersonate another person or misrepresent your affiliation;
  • Upload or transmit malware or other harmful code.

We may modify, suspend, or discontinue any part of the Site at any time without notice.

5) Information on Services, Pricing, and Availability
The Site describes services offered by Reverend Dr. Franklin Croes and Fabulous Ceremonies Aruba. Descriptions, pricing, and availability are subject to change and may vary by season, venue, and coordination needs. Currency indications on the Site (e.g., USD ($)) are for convenience and may be updated; the controlling terms—including fees, retainers, payment schedules, rehearsals, and cancellation/postponement policies—are those set out in your signed Service Agreement.

6) No Professional Advice; Inspirational Content Only
Site content (including planning tips, blog posts, checklists, and ideas) is for inspiration and general information. We do not guarantee accuracy, completeness, or suitability of the content for your purposes. You remain responsible for decisions and arrangements beyond our officiant scope unless expressly assumed in a written Service Agreement.

7) Intellectual Property
All materials on the Site—including text, logos, graphics, photos, videos, designs, and compilations—are owned by or licensed to the Company and protected by copyright, trademark, and other intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes. You may not copy, modify, distribute, create derivative works, publicly perform, or otherwise exploit Site content without our prior written consent.

7.1 User-Provided Materials (Testimonials & Images)
If you voluntarily submit reviews, testimonials, messages, or media (collectively, “User Content”), you represent that you own or control the rights to such content and grant the Company a worldwide, royalty-free, non-exclusive, sublicensable license to use, reproduce, adapt, publish, and display that content (in whole or part) for marketing and portfolio purposes in a manner consistent with our brand. You may revoke this license for future uses by writing to us; reasonable lead time is required to remove content from active campaigns.

8) Third-Party Links & Services
The Site may link to third-party websites or tools (e.g., payment processors, social platforms, vendor resources). We do not control and are not responsible for their content, policies, or practices. Inclusion of a link does not imply endorsement. Your use of third-party sites is at your own discretion and subject to their terms.

9) Disclaimers
The Site and its content are provided “as is” and “as available”. To the maximum extent permitted by applicable law, we disclaim all warranties—express or implied—including merchantability, fitness for a particular purpose, title, non-infringement, and uninterrupted or error-free operation. We do not warrant that the Site is free of harmful components.

10) Limitation of Liability
To the fullest extent permitted by law, the Company, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; or for loss of profits, goodwill, data, or other intangible losses arising from or relating to your use of the Site, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or relating to the Site shall not exceed USD $100. The foregoing does not limit liability that cannot be limited under applicable law.

11) Indemnification
You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use or misuse of the Site; (b) your violation of these Terms; or (c) your infringement of any third-party right.

12) Booking, Payments & Cancellations (Summary)
Booking terms, including retainers, balances, date changes, rehearsals, weather contingencies, accessibility accommodations, and any Celebration package coordination, are set out in your Service Agreement, which controls in the event of any conflict with the Site. Payment processing is handled by trusted third parties (e.g., Venmo, Wise, PayPal). We do not store full card/bank details on our servers.

13) International Users
We welcome couples from around the world. You are responsible for complying with local laws where you access the Site. For legal marriage requirements, civil procedures, or documentation, please consult official authorities. Many couples choose a symbolic Aruba ceremony with legal formalities in their home country.

14) Governing Law; Venue; Dispute Resolution (Aruba)
These Terms and any dispute or claim (contractual or non-contractual) arising out of or in connection with them are governed by the laws of Aruba, without regard to conflict-of-law rules.
Amicable Resolution: The parties will first endeavor to resolve disputes in good faith within 30 days of written notice.
Venue: Failing resolution, the courts of Oranjestad, Aruba shall have exclusive jurisdiction.
Arbitration Option: By mutual written agreement, the parties may submit disputes to confidential arbitration seated in Oranjestad, Aruba, conducted in English under the UNCITRAL rules or another mutually agreed set of rules.
 Nothing in this clause limits either party’s right to seek interim or injunctive relief in the courts of Aruba.

15) Force Majeure
We shall not be liable for delays or failure to perform due to events beyond our reasonable control, including but not limited to acts of God, weather events, fire, flood, strikes, labor disputes, epidemic/pandemic, government action, power failures, telecommunications or internet outages, or third-party failures.

16) Changes to the Site or These Terms
We may update the Site or these Terms from time to time. The “Last updated” date will reflect the latest revision. Your continued use of the Site after changes constitutes acceptance of the updated Terms.

17) Miscellaneous
  • Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement regarding Site use and supersede prior understandings related to the Site.
  • Severability: If any provision is found invalid or unenforceable, the remainder remains in full force, and a valid provision closest to the original intent will replace it.
  • No Waiver: Our failure to enforce any provision is not a waiver.
  • Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights to an affiliate or successor in connection with a merger, acquisition, or reorganization.
  • Headings: Headings are for convenience and do not affect interpretation.
